is there a step I am missing? It is possible that a Real-Time controller will obtain an IP Address and respond to network communication before LabVIEW Real-Time and additional drivers like NI RIO are loaded. The error shouldnot be there anymore. If you're using wired Ethernet, that means turn off the wireless (we also had a FireWire network connection showing that had to be disabled).

Static to Dynamic Network If you move your controller from a network where it was assigned a static IP address (e.g. NI-RIO server is running on the laptops with firewall disabled (I tried a static port first).
